Welcome to DriveWise Academy! These Terms & Conditions ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms with DriveWise Academy – 70663275762. If you disagree with any part of the Terms, please do not use our website or services.
1. Account Terms
You are responsible for all activity that occurs under your account. You agree to keep your account information accurate and up-to-date. You agree not to post or submit false information. You are responsible for maintaining the security of your account and password. You may not use DriveWise Academy for any illegal or unauthorized purpose. We reserve the right to suspend or terminate your account, refuse service, or remove or edit content, at any time and for any reason, without notice.
2. Lesson Scheduling, Payment Methods, and Driving Test Procedures
We offer a variety of driving lessons to suit your needs. Please visit our website or contact us for more information on scheduling lessons, available payment methods, and our process for preparing you for your driving test.
- Lesson Duration: Your driving lessons will last for one hour, including a pre-lesson briefing and post-lesson debriefing with your instructor to ensure you get the most out of your time.
- Lesson Start & Pick-Up: We'll pick you up at a location determined when you book your lesson, unless you and your instructor agree on a different spot. Traffic can be unpredictable, so your instructor may arrive a few minutes before or after your scheduled start time. Your lesson officially begins when your instructor arrives.
- Be Prepared to Start Early: To maximize your learning time, we kindly ask that you be ready to begin your lesson 15 minutes before your scheduled start time. If you're running late, your instructor will wait for 10 minutes. They may, at their discretion, deduct this waiting time from your overall lesson duration. If you arrive more than 10 minutes after your scheduled start time, your instructor may not be able to provide the full lesson and you may still be responsible for a cancellation fee (see cancellation policy).
- Test Day:
o Instructor Approval Required: Your driving instructor will only recommend you for a driving test with the Roads and Maritime Services (RMS) if they believe you are safe and fully prepared. Their approval ensures you have the necessary skills and knowledge to pass the test.
o Logbook Accuracy: It is your responsibility to ensure your learner logbook is complete and accurate before your driving test. We provide instructions on how to fill it out properly, but please double-check it meets all RMS requirements.
o Logbook Errors and Cancellation: If your driving test is cancelled due to errors in your logbook, you will still be responsible for paying the full Driving Test Package fee.
o Incorrect Test Details: If you are presented to the RMS for a driving test at the wrong time or location due to our fault, we will reschedule your test at no additional cost. However, if you provide incorrect information that leads to this error, you will be responsible for the full Driving Test Package fee.
o Vehicle Damage During Test: You are responsible for any damage caused to the vehicle during your driving test if an accident occurs while the instructor is not in the car with you. This may include excess fees payable to the insurer.
3. Student Responsibilities During Lessons
You must comply with the reasonable instructions or directions of your instructor at all times. This ensures a safe and productive learning environment for everyone. We reserve the right to terminate a lesson if:
- You engage in any behavior that your instructor determines is reckless or unsafe.
- You fail to comply with the instructions or directions of your instructor before or during a lesson.
- You fail to comply with any special conditions on your license, such as wearing glasses or contacts as required.
- You are unfit to operate a vehicle or suspected to be under the influence of drugs or alcohol as reasonably determined by us.
- You do not have a valid driver's license issued in Australia or an equivalent overseas license. You must carry your driver's license with you at all times during your lesson.
- You are not wearing enclosed shoes suitable for safe driving.
- You do not adhere to all safety policies and instructions provided by your instructor.
4. Account Management
You can manage your account information, view upcoming lessons, and update your preferences through our secure online portal.
5. Cancellation Policy
Cancellations made less than 24 hours before your scheduled lesson will forfeit the full lesson fee.
6. Unexpected Delays and Instructor Changes
We understand that unforeseen circumstances can arise. While we strive to start your lesson on time with your chosen instructor, things beyond our control may occasionally cause a delay or require us to assign a different instructor with equivalent qualifications. In such cases, we'll do our best to accommodate you and offer you the following options:
- A full one-hour lesson with the available instructor at the rescheduled time.
- If a full one-hour lesson isn't possible, we'll gladly credit you for the missed time and allow you to reschedule your lesson or add the missed time to another lesson.
7. Disclaimer
The website and services are provided on an "as is" and "as available" basis. We do not warrant that the website will meet your specific requirements, be uninterrupted, timely, secure, or error-free. We are not liable for any damages arising from your use of the website.
8. Limitation of Liability
In no event shall DriveWise Academy, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if DriveWise Academy has been advised of the possibility of such damages), resulting from:
- The use or the inability to use the website;
- The cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website;
- Unauthorized access to or alteration of your transmissions or data;
- Statements or conduct of any third party on the website;
- Any other matter relating to the website.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State/Territory in which you reside, without regard to its conflict of law provisions.

11. Prohibited Conduct
We maintain a safe and respectful environment for all our staff and students. Abusive behavior towards staff, either in person, over the phone, or online, will not be tolerated. This includes, but is not limited to, threats, insults, and harassment. Any such behavior will result in immediate termination of services and potential legal action.
